New Mexico is a “no fault” divorce state which means you do not have to state a reason why you need a divorce. The only requirement is that at least one of you has lived in the state for at least the last six months.
Since New Mexico is a “community property” state, any property and debts received or incurred during the marriage must be split equally between you. Note: there is an exception for property you bring to the marriage, for gifts, and for inheritances you receive, but you need to be careful. But you do have the option to negotiate with each other. If you continue to disagree, the court will decide for you.
One of the most insulting parts of getting a divorce is the 30-day waiting period before the court can finalize a divorce. Which can take even longer if it’s a nasty split or your spouse can’t be found. Don’t worry. We will stick it out with you.
